Deemed Conveyance

Deemed Conveyance is a legal provision that enables housing societies to obtain the legal ownership of the land and building from the builder or developer when the developer fails to execute the conveyance deed within the stipulated time. In many cases, builders delay or avoid transferring the ownership rights of the property to the cooperative housing society, which creates difficulties for residents in exercising their legal rights over the property. Deemed Conveyance provides a solution to this issue by allowing the society to approach the competent authority to obtain the ownership rights through a legal process.

Under this provision, the housing society can submit an application along with the necessary documents to the appropriate government authority. After verification and hearing both parties, the authority may grant the conveyance order in favor of the society. This order legally transfers the rights of the land and building to the housing society even without the builder’s consent.

Obtaining Deemed Conveyance is important for societies as it helps them secure their property rights, undertake redevelopment projects, and make important structural decisions. It also ensures transparency and legal protection for the members of the society. Through this process, residents gain full control and ownership of their property, which strengthens the legal standing of the housing society and protects the interests of all its members.
